The (in)capacity of existing legal structures regulate new relationships
Rules for distributing proof’s burden and application to digital law

The present study will define the challenges of Law in the face of new relationships arising from new technologies. Digital Law can be seen as a rupture with the traditional system or an evolution of pre-existing Law. This study will seek the best framework for Digital Law. It will also seek to identify whether existing legal mechanisms are sufficient to resolve new demands. Various relationships emerge in this new scenario and, with this, different conflicts. The parties need to prove their positions and the distribution of proof’s burden already existing in the procedural rules may not be sufficient to resolve these new conflicts. In this way, it will be analyzed whether vulnerable people are protected face of the virtual world that is unfolding, whether they have sufficient protection face of technological innovations and whether the dynamics of distribution of proof’s burden is already sufficient for this protection and is applicable to Digital Law.
