O novo Código Civil e os prazos de prescrição administrativa em caso de responsabilidade do Estado e de apossamento administrativo – um estudo a partir da jurisprudência do STF e do STJ

The present article aims to analyse two polemical aspects in the field of the responsibility of the State. The first of them has to do with the change in the jurisprudence of the STJ (Superior Court of Justice of Brazil) that now considers that the time of prescription of the legal suits on liability of the State is of three years, according to the new Civil Code of 2003, article 206, §3º, V, not being of validity anymore on this matter the Federal Decree 20.910/32. We shall also discuss, secondly, about the influence of the new Civil Code on the matters of the timing in which operates the expropriation in favour of the State, in the cases that are not anticipated by prior indemnification, with discussion about the jurisprudence of the Supreme Court of Brazil.
