The electronic process as an implementation of the right to a reasonable duration of the process and its rapid processing

Abstract

Technological advancement has been one of the factors of change in relationships within society and law, which is responsible for regulating legal relationships, has been adapting to such updates, with digital law being an innovation that permeates the various legal branches. With this, the electronic process emerges as an option for optimizing forensic work and adapting the Judiciary to this new legal scenario. In this way, using the field of study of digital law through bibliographical research, the general objective of the work was able to demonstrate the impacts of technological advancement and instrumental objectives, expose the changes in forensic practice with the advent of the electronic process, analyze the harmonization of these changes with art. 5th, item LXXVIII, of the Federal Constitution. Furthermore, the deductive method was used when dealing with doctrine and legislation related to the topic covered in the research. Thus, after a study on the impacts of digital law and the electronic process on the right to a reasonable duration of the process and the speed of its processing, the result was reached that its advent brought speed to the procedural process, concluding through cooperation in implementing the constitutional right to a reasonable duration of proceedings.
