The role of domestic violence courts in the protection of childhood and the constitutional principle of absolute priority

Abstract

This article is situated in the field of Child and Adolescent Law and comprehensive child protection, focusing on the role of specialized domestic and family violence courts. Its primary objective is to critically examine how these judicial structures contribute to mitigating the impacts of intrafamilial violence on children exposed to direct or indirect violence, considering the constitutional imperative of absolute priority. The methodology was based on documentary and bibliographic analysis of national and international sources, emphasizing impact studies, institutional reports, and systematic reviews on the effectiveness of specialized courts. The results show that, although these courts represent significant advances in victim protection, especially for children, they still face structural, methodological, and evaluative challenges that limit their full effectiveness. The study concludes that the effectiveness of such courts depends on sustained, evidence-based, and child-centered interventions, with the adoption of resolvent practices and the strengthening of interagency support networks being promising paths for improving the system.
